A reserve military soldier who is facing a rape charge has been ordered to remain on good behaviour by the High Court in Suva.

The 22-year-old accused appeared before Judge Justice Daniel Goundar yesterday.

He is charged with one count of rape.

The alleged incident occurred on July 8, 2019, at Nasinu, Suva.

The complainant in the matter is 16 years old.

State prosecutor from the Office of the Director of Public Prosecutions Swastika Sharma told the court that the accused met the complainant through some friends and on Facebook, but did not have a direct relationship.

She also told the court that the accused in his caution interview had stated that they had sexual intercourse, but it was consensual.

Justice Goundar granted bail to the accused on the bail bond sum of $1000 and two sureties’ bond sum of $1000 each.

He ordered the accused to:

  • Reside with his father in Suva,
  • Surrender his passport,
  • Not to obtain any travel documents,
  • Not to contact the complainant directly or indirectly,
  • Not to interfere with the prosecution witnesses and
  • To remain on good behaviour.

The accused was also ordered to report to Nabua Police Station every Saturday between 6 am and 6 pm.

The matter was adjourned for plea on November 1, before Judge Justice Riyaz Hamza.
