Man Acquitted Of Rape At Labasa High Court

The High Court in Labasa has acquitted a man who was charged with one count of rape.

The accused appeared before Justice Riyaz Hamza on Monday.

Justice Hamza had concurred with the not guilty opinion of the accessors.

“It is clear that the assessors too have not believed the evidence of the prosecution as entirely truthful and reliable, as they have by a unanimous decision found the accused not guilty as
charged,” Justice Hamza said.

“While the complainant was taking the lead, the accused then ran from behind and swung him and bit his neck. The complainant told the accused to get of him.

“The complainant while reaching home he had not told anyone about the incident. He said he was scared to tell anyone,” Justice Hamza said.

The accused however denied the alleged rape against him, however he admitted to biting the complainant on the neck.

Legal Aid Lawyer, Karen Boseiwaqa told the court that the complainant had failed to inform the police about what the accused had done to him while the complainant was lying down near the mango tree.
