Undischarged Bankrupt Case: Sentence Not Ready For Latchan, Says Judge

The Magistrates Court in Suva has deferred the sentencing of Rohit Ram Latchan.

Latchan appeared before Magistrate Asanga Bodaragama yesterday, however, Magistrate Bodaragama said the sentence was not ready.

Latchan is found guilty of two counts of undischarged bankrupt acting as a director.

He was charged for three counts of undischarged bankrupt acting as a director contrary to Section 189 (1) of the Companies Act, however, after the hearing, he was found guilty and convicted for two counts and acquitted on the third count.

Latchan on October 28, 2014, at Suva, declared a bankrupt by the Magistrates Court in Suva and not having received his discharged, acted as a director of or directly or indirectly took part in the management of Latchan Holdings Limited without the leave of the Court by signing as the Director of Latchan Holdings Limited on application for Caveat no 80485.

The matter has been adjourned for sentencing on March 3.
