Man Gets 12 Years For Raping Mentally-Impaired Cousin

A 34-year-old man has been jailed for raping his 27-year-old mentally-impaired cousin sister at her home in Taveuni.

The offender appeared before Judge Justice Daniel Goundar via Skype conference call from the High Court in Labasa yesterday.

On February 10, 2019, after drinking kava, the offender went to the victim’s home to eat and when he saw the victim was alone with her sister (also mentally-impaired), he raped her.

The court heard that the victim was born with cognitive disability and therefore had poor intellectual functioning and judgment and was unable to engage in logical conversation. She had always been under the care of her mother and had an older sister with a similar disability living with her.

The offender lived close to the victim’s home and was a regular visitor and was aware of the victim’s mental disability.

Justice Goundar said this was a case of sexual exploitation of a vulnerable victim with mental disability.

He has a non-parole period of eight years.
