A man who was charged with rape and left the country in violation of his bail conditions, has been sentenced to nine years, eleven months and twelve days in prison.

Saiyad Khan was in absentia, when the High Court in Lautoka sentenced him for raping a former employee.

The court heard that Khan had abused, drugged and raped the victim at a hotel in Nadi.

Justice Chamath Morais presided over the case.

He said the complainant was a university student who came to work for Khan to earn money for her university studies.

“Instead of helping her, you drugged her and preyed upon her. It is obvious that you drugged her since she did not consent to have sexual intercourse with you,” he said.

Justice Morais said the aggravating factors were that there was a gross breach of trust, the crime was preplanned and the impact of the crime on the victim was traumatic.

The court heard that considering the time the accused had spent in remand, the time remaining to be served was nine years, eleven months and twelve days with a non-parole period of six years.

Justice Morais said: “The period of imprisonment would commence from the date you will be arrested. The Fiji Police Force, Interpol and the Fiji Immigration to be noticed and an international arrest warrant to be issued.”

Khan has 30 days to appeal his sentence to the Court of Appeal.
