Rapist Guilty Of Defilement 48 Years Ago, Court Told

It was brought to the attention of the High Court in Suva yesterday that a 69-year-old rape offender had previous matters dating back to 1968.

The accused appeared before Justice Riyaz Hamza charged with raping his grandniece in his bedroom in 2018.

He pleaded guilty to the offence.

During his sentence hearing, his lawyer from the Legal Aid Commission pleaded with the court to consider him as a first offender because his last conviction was in 2000 and he has been on good behaviour ever since.

While reading through the case file Justice Hamza mentioned that the accused was previously convicted for charges of drunk and disorderly, act with intent to cause grievous harm and throwing an object.

In 1972 he was sentenced to three months imprisonment for a charge of defilement.

State lawyer Unaisi Tamanikaiyaroi said the aggravating factors was that it was an opportunistic crime in that the victim was raped when she was sent to the accused’s house to retrieve a bag.

Other aggravating factors include the breach of trust, the age difference of 58 years and the victim’s vulnerability.

The accused is in remand and will be sentenced on August 31.
