Magistrate Seini Puamau will deliver her ruling on Freesoul Real Estate Development (Fiji) PTE Limited’s evidentiary hearing on October 16.

Evidentiary hearing involves eyewitness testimony, given under oath, that’s relevant to the case. This was done yesterday.

Freesoul Real Estate Development (Fiji) PTE Limited is charged by the Director of Public Prosecutions with one count each of undertaking unauthorised developments and of failure to comply with a prohibition notice.

Director for Department of Environment, Sandeep Kaur Singh, told the court yesterday that she had issued and signed the prohibition notice issued to Freesoul on June 1, 2018, advising the company that it was prohibited from conducting any construction work.

She said two officers from the Department of Environment had accompanied Acting Director for Lands and other Government agencies officers to the site and reported back to her.

She said the pair, who had gone to inspect the site, were not appointed as inspectors by the Department of Environment. Their job description stated that the officers would carry out enforcement works.

Ms Singh said they were appointed by the Permanent Secretary last month because of the issues faced in this case.

The State has been given time until September 24 to file their written submissions while the defence has been given until October 8.

The State was represented by Shelyn Kiran from the Office of the DPP while Freesoul Real Estate by senior lawyer David Toganivalu.
