Ba football players, Saula Waqa and Manasa Nawakula have filed a constitutional redress against the president of Fiji Football Association Rajesh Patel and chief executive officer Mohammed Yusuf.

Waqa and Nawakula are currently suspended after testing positive for marijuana on August 7 during the Punjas Battle of the Giants tournament in Lautoka.

Anti-doping tests were conducted on both players by the Fiji FA medical committee in which Waqa and Nawakula were found positive for the use of prohibited substances (drugs) which is not permitted in football.

Waqa and Nawakula were handed suspension of three years from all levels of football related activities which also includes playing football at any level with immediate effect and $500 fine each.

Lawyer for both applicants, Abhay Singh has filed a constitutional redress in court seeking a declaration that the suspension was a breach of the Fijian Constitution and also sought the methods of testing used in Waqa and Nawakula’s case.

Waqa and Nawakula have claimed that the drug tests conducted were illegal or being done in breach of their rights.

They are seeking damages against both respondents (Patel and Yusuf).
