Woman Who  Raped Daughter Refused Appeal

The Fiji Court of Appeal has refused the appeal application for a 49-year-old woman convicted for raping her biological daughter.

The single mother of four is facing a jail sentence of 13 years with a non-parole period of 12 years for rape and sexual assault offences.

Her daughter was 14 years old at the time of the offences.

The rapist committed the offence between January 1 and July 5, 2016 at their home in Nasinu.

The appellant had appealed against her sentence and conviction on the grounds that the learned trial judge erred in law and in fact when he failed to direct the assessors and himself on the principle of recent complaint and/or delayed reporting and that the sentence imposed on the appellant was harsh and excessive.

However, Justice Chandana Prematilaka ruled that there was no reasonable prospect of success in the grounds of appeal and refused the application for leave to appeal against conviction and sentence.

The woman was convicted in November, 2017.
