Judge Finds Complainant’s Evidence Unreliable, Acquits Man Of Rape

A man who was alleged to have raped a woman he met at a nightclub in Suva, has been acquitted by the High Court in Suva.

The man was charged and tried for two counts of rape.

The 26-year-old complainant claimed she was raped twice at his house while she was intoxicated on October 17, 2019.

The complainant claimed it was the first time she had met the man who invited her for drinks.

In the judgment, Justice Vinsent Perera found the account given by the complainant regarding her encounter with the man to be unreliable.

Justice Perera said it was evident that the complainant was not sure and did not remember what really happened between her and the man mainly because of the level of intoxication during the material time.
