Judge Slams Hayne

Judge Syme told the court: “I do not accept that he was not aware that she was attempting to push him away and trying to physically resist him. It was very clear she said no several times.”

Jarryd Hayne has declared in court “I didn’t do it” just hours before he was sentenced to five years and nine months for raping a woman in her Newcastle home.

Judge Helen Syme made the judgement at the Newcastle District Court yesterday.

Judge Syme told the court: “I do not accept that he was not aware that she was attempting to push him away and trying to physically resist him. It was very clear she said no several times.”

She said Hayne’s “very difficult” upbringing had no impact on his “entitled behaviour next to this young woman who simply refused to have sexual relations with him”.

The court heard the former Fijian rugby league international and sevens rugby player’s attitude could not be fixed by Hayne “going to church”.

Judge Syme said Hayne was a good father and positive contributions to the community but had shown no remorse over the incident and needed to change his attitude to consent, women and sex.

Hayne, 33, has been in court for a sentence hearing after he was found guilty by a jury in March of the sexual assault of the then 26-year-old woman at her Fletcher home on Newcastle’s outskirts in September 2018. Hayne took the stand on Thursday where he continued to deny that he performed oral and digital sex on the woman without her consent.
