Tribunal To Decide Sharma’s Fate

A Tribunal, on the advice of the Judicial Services Commission, will sit to decide the fate of suspended Solicitor-General, Sharvada Sharma.
Mr Sharma was suspended on Monday, September 20, 2021, by the President of Fiji, Major-General (Ret’d) Jioji Konrote.
Chairman of the Commission, Chief Justice Kamal Kumar said a meeting was held on Monday to advise the President to act under Sections 116 and 112 (1) and 112 (4) of the Fijian Constitution.
Section 112 (1) states that a judicial officer appointed by the Commission may be removed from office for inability to perform their functions (whether arising from infirmity of body or mind or any other cause) or for misbehaviour, and may not otherwise be removed.
Section 112 (3) states that if the President, acting on the advice of the Commission, considers that the question of removing a judicial officer appointed by the Commission from office ought to be investigated for alleged misbehaviour then a tribunal would be appointed to investigate the matter.
Section 116 (4) states that the President may suspend the judicial officere from office pending investigation and referral to and appointment of a tribunal under subsection (3), and may at any time, revoke the suspension.
Attempts made to seek comments from Mr Sharma, were unsuccessful by the time this edition went to press.
