Ashneel Avishay Kumar, who was initially charged with the murder of a 34-year-old woman in Teidamu Lautoka last year, walked out of the High Court in Lautoka yesterday a free man.

This was after the High Court in Lautoka dismissed the charges against Kumar after the state lawyer Unal Dev Lal filed a nolle prosequi.

Ashneel Avishay Kumar and his father Ajay Kumar were initially charged with the alleged murder of the late Saleshni Devi, who died in a car incident at Teidamu, Lautoka on September 15, 2021.

This was after the vehicle she was in went down a cliff at Teidamu, Lautoka.

Mr Lal told the court that the state had served the first phase of disclosures and sought 14 days to file the second phase of disclosures.

The court heard that the state also filed a nolle prosequi for the first accused.

Justice Sunil Sharma said that since the state had filed a nolle prosequi for the first accused, the proceedings were therefore discharged.

The defence lawyer Iqbal Khan told the court that the second accused Ajay Kumar was still admitted at the Lautoka Hospital for a bleeding issue and that he was unable to speak to his client as there were no visitors allowed.

Justice Sharma ordered that the Medical Superintendent of the Lautoka Hospital forward the second accused’s full medical report to the High Court registry.

The court heard that Ashneel Avishay Kumar was released and his charge dismissed.

Justice Sharma adjourned the matter to January 18 for mention.
