Chief Justice Dismisses Bail Review Application For Teidamu Murder Accused

The President of the Supreme Court, Chief Justice Kamal Kumar has dismissed the bail review application filed by the lawyer of the Teidamu murder accused.

On December 16, 2021, the lawyer for murder accused Ajay Kumar, filed an Application for Review of Justice Rajasinghe’s Ruling delivered on November 29, 2021, and for an Order that Kumar to be granted bail pending trial on such terms and conditions as the court deems fit and proper.

Kumar is charged with one count of murder of a 34-year-old woman.

He is alleged to have murdered Saleshni Devi, on September 15, after the vehicle she was in went down a cliff in Teidamu, Lautoka.

The learned magistrate transferred the matter to the High Court in Lautoka whereupon, Kumar filed an application for bail.

The bail application was heard on November 5, 2021, and on November 29, 2021, the Judge delivered his decision whereby he refused the application for bail pending trial.

Supreme Court President, Chief Justice Kumar said: “This court finds that the application for review of bail ruling filed in this court is a clear abuse of court process and should be struck out.

“Since the application is an abuse of court process, this court will not rule on the application.”

He ordered that each party was to bear their own costs and dismissed and struck out the application for review of bail pending trial.
