Judge Orders For Quad To File Bail Application Tomorrow

The four people charged in relation to Jone Rusiate’s death in Nasikasika, Labasa, on June 5, will appear for their bail application at the High Court in Labasa tomorrow.

Judge Orders For Quad To File Bail Application Tomorrow

The four people charged in relation to Jone Rusiate’s death in Nasikasika, Labasa, on June 5, will appear for their bail application at the High Court in Labasa tomorrow.

This is after high court Judge, Justice Aruna Aluthge told lawyer, Abhay Singh, that the magistrate order issued for Amrit Sen to make bail application before the high court on June 30 could be ignored.

Mr Singh is representing the accused Labasa lawyer Sen and three others, Shumenda Chandra, Joji Bale and Maqtadeer Saif Kaiyum.

 

Sen Is Charged With:

  • One count of murder,
  • Two counts of attempted murder,
  • One count of conspiracy,
  • Seven counts of act with intent to cause grievous harm,
  • Two counts of criminal intimidation,
  • One count of assault causing actual bodily harm and
  • One count of damaging property.

Chandra was charged with one count of conspiracy and a count of assault causing actual bodily harm.

Kaiyum and Bale were charged with one count each of conspiracy.

Although Mr Singh argued for 40 minutes in an effort to get the four bailed, State prosecutor Michelle Lomaloma strongly opposed.

 

She said if they (accused) filed fresh bail applications there has to be a change of circumstance.

Justice Aluthge, said the magistrate’s order was still valid and it was a matter of two days of waiting.

The case has been adjourned tomorrow.
