Defence Awaits Post Mortem Examination Report, Photographs

Defence lawyer Alanieta Bilivalu told the court yesterday that she was yet to receive the post mortem examination report with its photographs, the forensic officers’ statements including a statement from the pathologist.
Ms Bilivalu had come on board representing accused person, Maika Bavou who is charged with one count of murder.
He appeared before High Court Judge, Justice Riyaz Hamza at the High Court in Lautoka.
The accused is alleged to have assaulted his daughter’s 19-year-old partner, Saimoni Virai at Vatukacevaceva Village in Ra in August where Mr Virai sustained serious injuries allegedly resulting in his death.
Bavou was also alleged to have staged the crime scene to make it appear as suicide.
Justice Hamza said the documents were important and he urged Ms Bilivalu to provide the relevant people a deadline.
He said it had also been three months since the alleged murder took place.
State lawyer, Muhammed Rafiq submitted that the disclosures had been served, Ms Bilivalu confirmed receiving them yesterday.
State sought further time to file the information.
In his bail matter, Ms Bilivalu had sought seven days to file a supplementary affidavit.
Justice Hamza said for the State to have their response ready in seven days.
The matter has been adjourned to November 23.
