21-year-old gets suspended sentence for defilement

A 21-year-old man convicted of defilement and sexual assault involving a 14-year-old neighbour has been spared immediate imprisonment after the High Court in Labasa assessed his risk of reoffending as low.

The man, who was 20 at the time of the offence, was sentenced to 10 months’ imprisonment, suspended for two years.

He had initially been charged with one count of rape and one count of sexual assault. Following a trial, he was convicted of the lesser offence of defilement and one count of sexual assault.

He appeared before Justice Lee James Burney this week.

The court heard that the man was a school dropout who now sells copra and works as a casual labourer in his village.

He also lives with and looks after his grandmother, maternal aunt and two younger cousins.

The court heard that in January 2025, he began a relationship with the complainant, who was then 14.

They were neighbours, and he would often spend time at her house.

On April 24, 2025, the complainant and her sisters went to his cousin’s house for a sleepover.

During the sleepover, the sexual offending for which he was convicted took place.

The offending came to light after the complainant’s younger sister reported what she had seen that night.

Justice Burney said the offender accepted full responsibility for his actions and had expressed sincere remorse for the harm caused.

He expressed a desire to become a law-abiding citizen and had shown positive prospects for rehabilitation.

Justice Burney also said the likelihood of reoffending had been assessed as low.

The man was sentenced to 10 months’ imprisonment, suspended for two years.
