Apete Kaisau’s Appeal Dismissed

Justice Daniel Goundar yesterday dismissed the appeal of a man, who is under care orders of the Fiji Corrections Service at the Naboro Maximum facility.

Apete Vakananumi Kaisau was found not guilty of murder by reason of insanity in 2003 for killing former Fiji Red Cross Director John Scott and Gregory Scrivener in the year 2001.

He had filed an appeal to the issues and his grievances of a nolle prosequi that was filed by the Director of Public Prosecutions in the Chief Magistrates Court in 2003.

Legal Aid Commission lawyer Lice Manulevu informed the court that Kaisau’s continued custody and mental health care was ordered in 2019 by Justice Salesi Temo. In court, Kaisau became disruptive and exhibited a threatening demeanour.

Justice Goundar asked the Prison escorting officers to escort Kaisau outside of the courtroom and back to the cell block.

He ruled that the appeal was an abuse of process and dismissed it accordingly.
