Chief Magistrate Usaia Ratuvili will deliver his ruling on March 23 on defence’s no case to answer application in relation to a man on trial for indecent assault charges.
This is for the second complainant’s evidence who alleged that the accused hugged her, rubbed her back and sniffed her.
Defence lawyer, Hemendra Nagin from Sherani & Co, argued that the second complainant’s evidence could not be held credible.

He told the court that it was only after the second complainant had seen the first complainant’s Facebook post of a similar alleged incident like hers that she lodged a complaint.
Why did it take so long, there was no answer to that, Mr Nagin argued.
In rebuttal, State lawyer, Sadaf Shameem from the Office of the Director of Public Prosecutions said that the complainant found the courage after the first complainant’s Facebook post.
She told the court that the second complainant delayed her report to Police because she was scared given the authority and power of the accused.
