The case was called at the Civil High Court in Suva before Justice Brito Mutunayagam yesterday for hearing on the defendant’s strike out application.
SODELPA and its executive members’ lawyer, Romanu Vananalagi filed the summons to have the matter struck out on the grounds that the lawsuit disclosed no reasonable cause of action, that it was scandalous, frivolous or vexatious and it otherwise was an abuse of the process of the court.
Rayawa’s counsels Simione Drole and Kalisito Maisamoa argued that the strike out application did not have any affidavit in support to show the evidence of the originating summons being vexatious.
