Former PM, Qiliho judgment deferred

Both appeared before Justice Thushara Rajasinghe today, hoping for a ruling.

The High Court in Suva has sought further clarification from both parties before delivering judgment in the case of former Prime Minister Voreqe Bainimarama and former Police Commissioner Sitiveni Qiliho.

Both appeared before Justice Thushara Rajasinghe today, hoping for a ruling.

Bainimarama faces one count of making unwarranted demands, after allegedly instructing then Acting Police Commissioner Rusiate Tudravu to either dismiss two officers who had taken photographs of his brother during a drug investigation or resign.

Qiliho is charged with two counts of abuse of office for reviewing the officers’ punishments and later terminating them.

The court informed the parties that the judgment was ready, but clarification was needed on certain sections of the 2013 Constitution relating to the appointment of an Acting Police Commissioner when the Commissioner is overseas. Justice Rajasinghe referred to Sections 163(2), 129(4), and 134(4).

Both parties have until Monday afternoon to file additional submissions. Judgment is expected next Thursday.

Bail for both accused was extended.
