Freesoul Case Sentencing To High Court
The ruling was made by Magistrate Seini Puamau yesterday who said there is discretion to transfer the case in the circumstances that the nature of the case require a higher penalty.

The case against Freesoul Real Estate Development (Fiji) PTE Limited has been transferred to the Suva High Court for sentencing.
The ruling was made by Magistrate Seini Puamau yesterday who said there is discretion to transfer the case in the circumstances that the nature of the case require a higher penalty.
She said transferring the case to the High Court would be in the best interest of both parties.

During the transfer hearing, Freesoul lawyer David Toganivalu had objected saying the transfer application was made by the State in bad faith and that the law does not permit transfers after trial of a company is completed.
Freesoul was found guilty and convicted for two counts of undertaking unauthorised developments between June 8, 2017 and December 6, 2018 at Malolo Island in Nadi.
The case will be called in the High Court on November 10.
