Fiji Independent Commission Against Corruption (FICAC) former commissioner, Barbara Malimali is ready to plead her case in a hearing set for October 27. 

Malimali’s lawyer Samuela Savu, made this clear when appearing before Justice Dane Tuiqereqere at the High Court in Suva yesterday. 

In this matter, Malimali is seeking leave from the High Court to file a judicial review into her claimed unlawful termination by Government. 

During the proceedings Mr Savu objected to the State’s request seeking more time to file their affidavit of reply. 

He argued the non-compliance of State to file its affidavit within the 28-day period given by the court meant that he is liable to pay costs of $1500. 

Court orders were given since July 21 and the 28-day period ended on August 29. 

Deputy Solicitor-General Eliesa Tuiloma, who is representing the Government, requested another seven days to file their affidavits. 

He said they were only proposing three hours to fight their case during the hearing 

The court allowed the State to file its affidavit of reply with orders to pay $1500 by Friday. 

As of now, the State has been given until September 19 to file its affidavit of opposition after which the applicants will then have until October 3 to reply. 

The applicants are to make their submissions by October 17, after which the respondents will have three days thereafter to make theirs. 

The matter will be called again on October 27 for hearing.
