Man charged with rape bailed after objection fails

He was granted bail on conditions including a non-cash bail bond, no interference with State witnesses, good behaviour, and attendance at all court proceedings.

A 55-year-old man from Naitasiri charged with rape was granted bail on Friday after the High Court in Suva found the prosecution’s objections were weak.

The accused is alleged to have raped his sister-in-law on November 20 last year. He pleaded not guilty before Justice Daniel Goundar. State Prosecutions informed the court that no admissions were made during his caution interview.

State Prosecutor Pream Ram objected to bail. However, defence lawyer Tobia Ravuniwa presented a photograph in court which he claimed showed the complainant and the accused engaging in consensual sexual intercourse.

Mr Ravuniwa submitted that the pair had been involved in an extramarital affair for 10 years and that the accused’s wife was aware of the relationship.

The complaint was lodged about a month after the alleged incident.

Mr Ravuniwa also told the court that the photograph had circulated in the village, which he argued may have prompted the complainant to file the rape allegation.

After considering submissions from both sides, the court ruled that the prosecution had not established sufficient grounds to keep the accused in remand.

He was granted bail on conditions including a non-cash bail bond, no interference with State witnesses, good behaviour, and attendance at all court proceedings.

A restraining order was also issued requiring the accused to live with his wife away from the complainant’s residence.

The matter was adjourned to March 3 for mention.
