PM consults President after Malimali dismissal ruled unlawful

Prime Minister Sitiveni Rabuka met President Ratu Naiqama Lalabalavu at State House this morning, following a High Court ruling that declared the dismissal of former FICAC Commissioner Barbara Malimali unlawful.
On Monday, High Court Judge Justice Dane Tuiqereqere ruled that the Constitution was clear that the FICAC Commissioner was appointed by the President on the advice of the Judicial Services Commission (JSC), not the Prime Minister.
Justice Tuiqereqere ruled that Prime Minister Sitiveni Rabuka therefore did not have the power to advise the President to revoke Malimali’s appointment.

The meeting with the President, which lasted about an hour, is understood to have focused on the legal options now available to the Prime Minister in light of the ruling.
Mr Rabuka appeared relaxed following the audience and acknowledged members of the media before departing State House.
He is expected to consider legal advice from Solicitor-General Ropate Green while awaiting a decision from the Judicial Services Commission on the matter.
Developments are expected in the coming days as the legal process continues.
