Undischarged Bankrupt Case: Latchan Guilty Of Holding Company Role

The Magistrates Court in Suva has found Rohit Ram Latchan guilty of two counts of undischarged bankrupt acting as a director.

The Magistrates Court in Suva has found Rohit Ram Latchan guilty of two counts of undischarged bankrupt acting as a director.

He will be sentenced today by Magistrate Asanga Bodaragama.

Latchan was charged with three counts of undischarged bankrupt to act as a director contrary to Section 189 (1) of the Companies Act.

However, after the hearing, he was found guilty and convicted for two counts and acquitted on the third count.

Latchan on October 28, 2014, at Suva declared a bankrupt by the Magistrates Court in Suva and not having received his discharge acted as a director of or directly or indirectly took part in the management of Latchan Holdings Limited without the leave of the Court by signing as the Director of Latchan Holdings Limited on the application for Caveat no 80485.

Latchan on the same day at Suva, being declared a bankrupt by the Magistrates Court in Suva and not having received his discharge acted as a director of or directly or indirectly took part in the management of Latchan Holdings Limited without the leave of the Court by signing as the Director of Latchan Holdings Limited on the application for Caveat no 804806. Magistrate Bodaragama said that prosecution had proved all elements of the first and second count of undischarged bankrupt acting as a director against Latchan and that the accused failed to create any reasonable doubt in the prosecution evidence.
