‘Xcon’ gets suspended sentence, $1k fine

A 31-year-old farmer who made derogatory and harmful comments about Minister for Information Lynda Tabuya online has been given a suspended sentence by the High Court in Suva.

Lui Vuiberata, also known as Xcon, received a non-custodial sentence before Justice Daniel Goundar this morning.

Vuiberata pleaded guilty to one count of causing harm by posting electronic communication, criminal intimidation and indecently insulting or annoying a person.

Pursuant to Section 26 of the Sentencing and Penalties Act 2009, the court sentenced him to eight months’ imprisonment, suspended for two years.

He was also fined $1000, which must be paid within one month. Failure to pay the fine could result in an additional three months’ imprisonment.

The court acknowledged the harm and emotional distress caused to Ms Tabuya, noting that she is a woman in a leadership role and a mother.

Justice Goundar said recording a conviction was necessary to denounce the conduct and deter similar offending.

The accused has also been granted bail for three counts of breaching bail conditions, which are currently before the Suva Magistrates Court.
