Government’s chief legal adviser Attorney-General Graham Leung has acknowledged the appointment of John Rabuku as deputy Director of Public Prosecution (DPP).

Mr Leung’s comments come following Mr Rabuku’s new appointment, five weeks after he vacated his acting DPP position.

Mr Rabuku’s appointment as deputy DPP was announced by the acting DPP Nancy Tikoisuva on Wednesday.

Last month, Mr Leung urged Mr Rabuku to vacate the position of acting DPP after the Supreme Court made an opinion regarding his appointment as ‘ineligible’.

“Under the Constitution, the DPP is empowered to appoint his/her own staff,” Mr Leung said.

“By law that is a decision made by the DPP alone, or the person acting in that position; and not one made by the Judicial Services Commission or the Attorney-General,” he said.

“There was no legal requirement or obligation to consult me on this, or seek my approval.”

Mr Leung clarified that if the acting DPP goes on leave, it is not a foregone conclusion by any means that her deputy would automatically assume that responsibility.
