The Civil High Court in Suva has struck out the appeal application filed by the Fiji Rugby Union (FRU) former financial officer, Pawan Deo, against the Trust Board.

The appeal was struck out following Deo’s withdrawal of the case against FRU.

FRU had taken legal action against Deo, his wife, and their company, Sports Supplies Lim-ited, for embezzling funds and sought compensation of about $7000.

The matter was previously heard in the Nasinu Magistrate’s Court.

After the FRU withdrew their case on July 24, Deo filed a counterclaim seeking compensation for the financial and non-financial burden caused by the FRU.

During yesterday’s proceedings, Deo told the court that the Civil High Court registry had sent him back and forth between Suva and Nasinu in an attempt to retrieve copies of his application.

He told the court that, based on his lawyer’s instructions, he was withdrawing the application and would file a new one at a later date.

FRU’s lawyer, Tomasi Tuitoga, told the court they had no issues with the plaintiff ’s withdrawal, but sought compensation of $200. The compensation is to be paid by Deo before November 27.
