Human rights weakening village rules, CRC hears

A villager of Wailotua Naba Rua in Wainibuka told the Constitution Review Commission (CRC) yesterday that there should be a stronger recognition of village authority in Fiji’s Constitution.
Mataiasi Dinavuso said traditional rules were being weakened by the growing misuse of individual rights.
Making submissions during the CRCs consultation he outlined how respect for village laws and leadership was slowly declining because some people used human rights as an excuse to ignore community rules.

Mr Dinavuso said village regulations were put in place to maintain peace, order and respect among residents, but these were increasingly being challenged by individuals claiming they had personal freedoms that placed them above communal obligations.
“When they used loud music in the village, they said, they have their own rights when they’re approached,” he said
“When you live in a village, you should respect and obey the laws of that village, no matter your rights.”
Mr Dinavuso told the CRC that traditional structures had long played an important role in protecting culture, resolving disputes and maintaining social harmony, particularly in rural areas.
“You can use your rights outside the village,” he suggested.
“Those laws are there for a reason, to keep peace, discipline and unity within the community.”
The proposal submitted is that the Constitution include provisions that recognise and protect the authority of village by-laws, provided they are applied fairly and in the best interests of the community.
“Human rights are important, but they should not be used as a shield to disrespect village leaders, ignore community responsibilities or undermine our traditions,” he said.
CRCs consultation will continue today at the Nataleira Village Hall in Dawasamu and Naivuruvuru Village Hall in Verata.
