Nawaikula Withdraws Constitutional Redress Case

Nawaikula withdrew the case because the Act had already been amended on April 6, 2023, and was implemented on April 17, of that year.

Former Member of Parliament Niko Nawaikula has withdrawn his constitutional redress case regarding the amendment to the iTaukei Land Trust Act 2021.

He appeared before Puisne Judge Justice Daine Tuiqereqere at the High Court in Suva yesterday.

Mr Nawaikula’s pursuance of this case was in relation to the removal of landowners’ rights to give consent for their land.

He had claimed the 2013 Constitution took away those rights when the new Government came into power, the legislation was passed and returned to what it was before without having any consultations with them.

Nawaikula withdrew the case because the Act had already been amended on April 6, 2023, and was implemented on April 17, of that year.

During the court proceedings, Mr Nawaikula told the court that he had already made submissions and was awaiting approval from the court.

The court heard that all other parties involved had also signed for the discontinuance of the matter.

Justice Tuiqereqere thanked Mr Nawaikula for the effort shown and due diligence in saving the court’s time and resources.
