A 22-year-old man found guilty of raping his girlfriend in Labasa was sentenced to 12 years, 11 months and 23 days of imprisonment.

He appeared at the High Court in Labasa with one count each of assault causing bodily harm and rape on January 16.

The court heard that on August 6, 2022, the accused, who was 20 years old then, confronted his then- girlfriend, the victim, speaking to another boy at the Labasa Civic Centre.

The victim was 17 years old then.

She was then taken forcefully to his vehicle and driven off to the riverside near the Sangam Nursing School.

It was also heard in court that during the trial, evidence showed that the accused had confronted the girlfriend about talking to another boy.

After the accused forced her to unlock the phone and read through her messages, he then moved her to the back of the car seat, where he started hitting her arms and legs.

The accused then forced her to take off her clothes and raped her.

The court heard that for the offence of assault causing actual bodily harm, the accused was given 10 months’ imprisonment.

For the offence of rape, the court gave the accused 11 years, 11 months, and 23 days sentence.

The accused will serve a non-parole period of eight years and a final Domestic Violence Restraining Order, Standard Non-Molestation Condition was issued for the protection of the victim.

The accused has 30 days to appeal.
