Remand Prisoner Mistakenly Released

It was alleged that on June 2, 2022, at Tacirua, Suva in the Central Division, Sauturaga had carnal knowledge of the complainant, a child under the age of 13 years.

Prosecution has alleged that Nacanieli Sauturaga, who faces a charge for rape, was mistakenly released by the Fiji Corrections Services (FCS).

Appearing for the prosecution, State lawyer, Unaisi Tamanikaiyaroi, told the High Court in Suva yesterday that he had not been appearing for the case since July 30, 2023.

It was alleged that on June 2, 2022, at Tacirua, Suva in the Central Division, Sauturaga had carnal knowledge of the complainant, a child under the age of 13 years.

The incident took place at a shortcut (informal footpath) near Caubati when the victim was walking to school.

Puisne Judge Justice Pita Bulamainaivalu, after hearing the matter, asked the defence lawyer about attempts made to protect their client.

The defence lawyer from the Legal Aid Commission said he had called the FCS office about the matter; however, she was told he hadn’t been located yet since his release.

Ms Tamanikaiyaroi said Sauturaga made his first appearance on September 30, 2022 and his last appearance was on May 8, 2023.

Justice Bulamainaivalu then issued a bench warrant for the accused.

The court has summoned the presence of a FCS representative to explain the matter.

Defence lawyer has also been ordered to submit a report in the next hearing.

The matter has been adjourned to February 2.

The court has also ruled that the trial date will remain January 29.
