Trader Fined For Failing To Comply With Terms And Conditions Of An Enforceable Undertaking

M.S Rao Design Services has been fined $10,000 for failing to comply with the terms and conditions of an Enforceable Undertaking signed with the Fijian Competition and Consumer Commission (FCCC).

M.S Rao Design Services has been fined $10,000 for failing to comply with the terms and conditions of an Enforceable Undertaking signed with the Fijian Competition and Consumer Commission (FCCC).

FCCC successfully pursued the charge of failure to comply with the enforceable undertaking as the trader had promised to complete the complainant’s home within a specific timeframe but failed to do so. The Court noted the nature and the gravity of the offence and the circumstances under which the offence was committed; as such, a fine was imposed on the trader.

“A complaint was lodged against M.S Rao Design services for accepting $320,000 to construct a house which wasn’t completed within a reasonable timeframe,” said FCCC CEO, Joel Abraham.

“The trader’s failure to comply, even after FCCC’s best efforts at compromise is why we escalated the matter to the Magistrates Court so punitive measures could be taken.”

“We want to send a message to all Fijians that their rights as consumers are being protected, as well as ensure that those who are providing goods and services fulfil their obligations.”

FCCC has stated that if any complaint by a consumer has merit, and reasonable steps are not taken to address issues, they will not hesitate to take matters to court.
