Nawaikula labels 2013 Constitution ‘defective’

Stand With Niko (SWN) president Niko Nawaikula has described the 2013 Constitution as “defective”.

The former Member of Parliament said it contained “a lot of shortcomings” as his group prepares a public talanoa session at Fiji National University (FNU) Nasinu today.

The session aims to inform citizens ahead of proposed constitutional amendments, particularly regarding iTaukei rights, identity and group representation.

“The 2013 Constitution has serious gaps,” Mr Nawaikula said outside the SODELPA headquarters today.

“It does not adequately protect iTaukei rights or identity, unlike the 1970 and 1997 constitutions.”

He also raised concerns about weaknesses in the separation of powers, noting legal professionals are aware of these issues.

The talanoa session comes after the Government appointed a committee, headed by lawyer Sevuloni Valenitabua, to review and propose amendments to the 2013 Constitution.

Mr Nawaikula said the forum would include presentations from experts such as former Attorney-General Graham Leung, Dialogue Fiji director Nilesh Lal and Deputy Prime Minister Manoa Kamikamica.

“These speakers are experienced and knowledgeable, and the aim is to empower attendees with information to make submissions to the review committee,” he said.

He added that his presentation would focus on iTaukei issues, including ethnic identity, rights protection and recognition of the Bose Levu Vakaturaga, which he claims were removed from the 2013 Constitution.

He criticised the Constitution’s authors, calling them “racist” and “haters of iTaukei.”

Mr Nawaikula encouraged broad participation, emphasising the importance of gender balance and representation from all communities.

“It’s important to talk and discuss these matters in the province.”
