The Suva Magistrate Court is considering sending TikTok user Lui Vuiberata, 31, for psychiatric evaluation at Saint Giles Psychiatric Hospital under Section 104 of the Criminal Procedure Act.

Chief Magistrate Josaia Waqaivolavola raised the matter this morning after observing Vuiberata’s behaviour in court during an earlier proceeding when his bail was revoked.

Magistrate Waqaivolavola said Vuiberata’s facial gestures and conduct were concerning and warranted a mental assessment.

Vuiberata has been granted bail under strict conditions. His case will be recalled at 3pm today for the court to issue its orders regarding the psychiatric evaluation.

The charges stem from an allegation that on August 14, Vuiberata made derogatory remarks against Minister for Information, Lynda Tabuya, during a TikTok livestream.
