Court to hear Kamikamica’s bid to overturn FICAC Commissioner’s appointment

Hearing set for March 2026; defence says the appointment was “fundamentally flawed” and actions taken under it are invalid.

The High Court in Suva has set a hearing for next March to hear former Deputy Prime Minister Manoa Kamikamica’s application challenging the appointment of the Commissioner of the Fiji Independent Commission Against Corruption (FICAC), Lavi Rokoika.

Kamikamica appeared with his lawyer, Wylie Clarke, before Judge Warleen George yesterday.

In the application, Mr Clarke argued that the Judicial Services Commission (JSC) was not involved in the appointment process, and that the appointment was fundamentally flawed.

He said any actions carried out under that appointment were therefore null and void, including the charges filed against his client.

Mr Clarke informed the court that all paperwork had been filed at the Civil High Court Registry and that they were ready to set a hearing date.

Justice Bull has given FICAC until January 14 to file its reply to Kamikamica’s application. Kamikamica must then respond to FICAC by February 4.

All written submissions from FICAC must be filed by February 25, ahead of the hearing set for March 25, 2026.
