High Court gives TikToker 14 days to file appeal submissions

Justice Hamza reminds lawyers of procedures involving clients living overseas.

A TikToker appealing her conviction in a cyberbullying case involving Anisa Khatoon Gwaizda has been given 14 days to file written submissions.

The matter was called before Justice Riyaz Hamza in the High Court in Lautoka on Monday.

Richard Prakash of Prakash Lawyers appeared for Gwaizda, who is living overseas.

The appeal stems from proceedings heard and determined in the Nadi Magistrates Court about three years ago.

In the original case, Gwaizda was convicted on two counts of causing harm by posting electronic communications, contrary to sections 24(1) and 24(2)(a) of the Online Safety Act 2018.

The charges relate to allegations that between June 1, 2021, and January 1, 2022, Gwaizda posted electronic communications intended to cause harm to her step-sister and niece.

Following her conviction in the Magistrate Court, Gwaizda appealed to the High Court. Joeli Naivalu appeared for the prosecution.

During yesterday's proceedings, Justice Hamza stressed the importance of ensuring proper instructions are received from clients living overseas. He also clarified that a notice of change of solicitors is required only in civil matters and not in criminal proceedings.

The defence has been given 14 days to file its written submissions, while the prosecution has been granted one month to respond.

Justice Hamza also highlighted the need for coordination between counsel to ensure all relevant documents are available before hearings.

The matter was adjourned to August 27 for mention.
