Hyperchem seeks court injunction to halt sale of Nand’s Mall

Pharmacy fights to recover debts from struggling Superdrugs and Nand’s Pharmacy.

The lawyer acting on behalf of Hyperchem Pharmacy and its owner, Zaheera Cassim, has filed an injunction application against Superdrugs Pharmacy Pte Limited and Nand’s Pharmacy Pte Ltd.

They are seeking court orders to stop the sale of Nand’s Mall in Nabua.

This preliminary application is part of their bid to collect debts owed to them by the mall, which housed the two pharmaceutical outlets that are on the verge of going bankrupt.

The applicants, including businessman Aiyaz Mohammed Musa Umarji, are defendants in a substantive civil suit filed by Superdrugs Pharmacy Pte Limited and Nand’s Pharmacy Pte Ltd.

Accusations
The plaintiffs, Superdrugs Pharmacy Pte Limited and Nand’s Pharmacy Pte Ltd, are accusing the defendants of conspiring with Mr Umarji, former chief executive officer of Superdrugs Pharmacy, to purchase goods and products at inflated and exorbitant prices.

The plaintiffs also allege that Mr Umarji intentionally withheld the purchase and supply of products to Superdrugs Pharmacy, allowing consumers to buy the same products from Hyperchem Pharmacy.

They claim Mr Umarji intentionally and wrongfully marked up retail prices for the plaintiffs’ products, causing them to lose sales, profits, and suffer reputational damage.

As a result, Hyperchem Pharmacy initiated an application to wind up Superdrugs Pharmacy.

These circumstances also affected Nand’s Pharmacy, which was wrongfully forced to take over and amalgamate the total debt owed by Superdrugs Pharmacy. Nand’s Pharmacy also signed an equitable mortgage to secure a sum exceeding $3 million.

During yesterday’s proceedings, the defendant’s lawyer, Devanesh Sharma, sought to stop the sale of the mall, citing their interest in collecting the debt owed by the company.

Superdrugs Pharmacy and Nand’s Pharmacy, represented by Sherani & Co, have until January 7 next year to respond to the defendant’s application.

The hearing date is set for February 20, 2026.
