JSC confidentiality hearing set for next Thursday

Parties finalising settlement terms in judicial review over Malimali appointment.

The hearing on the confidentiality aspect of the Judicial Services Commission’s (JSC) judicial review application will be heard next Thursday.

The application seeks to quash the findings of the Commission of Inquiry into Barbara Malimali’s appointment as FICAC Commissioner.

The matter was scheduled for hearing yesterday but was adjourned to allow parties more time to finalise discussions.

JSC lawyer Isireli Fa said negotiations were ongoing regarding the final clause of the Terms of Settlement.

Mr Fa noted there were no major issues concerning confidentiality and suggested that any party wishing to view the agreement could apply to do so.

Meanwhile, counsel representing the Prime Minister and the Office of the Solicitor-General, Ropate Green Lomavatu, said discussions were continuing on how the confidentiality arrangements would be implemented.

He said all parties were largely in agreement on the final clause of the settlement terms.
