Missing digital evidence raised in 'Dr Leighley' murder case

The High Court in Lautoka has raised concerns over missing digital evidence ahead of the July murder trial of a man accused of killing a Nadi-based doctor.

During a hearing before Justice Aruna Aluthge yesterday morning, the court heard that a key piece of digital evidence, a CD containing voir dire material, remained unaccounted for despite multiple volumes of disclosure already being handed over.

Five volumes of disclosure documents had been provided to the defence in the case against Peceli Rokoravolo, 38, but the absence of the CD remained unresolved.

Discussions also focused on a USB device containing video recordings linked to the case, with arrangements being made to ensure both video and transcript materials were accessible to all parties.

State counsel acknowledged that some copies of documents were still pending and undertook to provide them promptly, while also confirming that video recordings would be shared upon request.

Justice Aluthge emphasised the importance of the missing CD and USB evidence, particularly ahead of the trial scheduled for July 6 and 7.

Rokoravolo is charged in relation to the alleged killing of Dr Isireli Biumaitotoya, also known as Dr Leighley Darling, between August 31 and September 1 last year.

He remains in custody.

The issue of complete disclosure is expected to be critical as the court prepares for trial, with the matter adjourned to June 9.
