Mr Rabuku said such claims are uncommon and have seldom resulted in a successful outcome.
"It has happened before, but rarely has it been successful anyway."
He further explained that the case can move to the Supreme Court if necessary.
Mr Rabuku said he would first discuss the lawsuit with Acting Director of Public Prosecutions Nancy Tikoisuva before deciding on the next course of action.
Addressing public concerns that legal proceedings could become a burden on taxpayers, Mr Rabuku defended the criminal justice process, saying prosecutions are based on evidence gathered during police investigations before cases are assessed by prosecutors and heard independently by the courts.
