Tiktoker in cyberbullying case appeals in High Court

Directions were issued for the appellant to file submissions, after which the State is expected to file its response.

The appellant in a TikTok cyberbullying case involving Anisa Khatoon Gwaizda has been granted 28 days to file submissions in the High Court in Lautoka.

The matter was called before Justice Riyaz Hamza, who directed the appellant to file submissions within 28 days before the State files its response.

The case was previously heard and decided in the Nadi Magistrates Court and is now before the High Court on appeal.

In the earlier proceedings, Gwaizda faced two counts of causing harm by posting electronic communications, contrary to Sections 24(1) and 24(2)(a) of the Online Safety Act 2018.

It is alleged that between June 1, 2021, and January 1, 2022, Gwaizda posted electronic communications intended to cause harm to her step-sister and niece.

Yesterday, Gwaizda was represented by Brown and Prakash Lawyers, while the State was represented by Sheenal Swastika.

Directions were issued for the appellant to file submissions, after which the State is expected to file its response.

A hearing date has yet to be fixed.
