JSC rejects severance pay condition linked to Rokoika’s removal

President responds with conditions as JSC deliberates the fate of the Acting FICAC Commissioner.

The Judicial Services Commission (JSC) is not authorised to make any recommendation regarding severance pay — a condition believed to have been raised by the President in relation to the removal of Lavinia Rokoika as Acting FICAC Commissioner.

This masthead understands that President Ratu Naiqama Lalabalavu had responded to the JSC’s recommendations, outlining several conditions before making a final decision.

The JSC met on Thursday to consider the matter.

Highly placed sources said the commission would not give in to the condition, emphasising that it is bound by the rule of law.

“.... who is saying she will get paid, no way; JSC is not privy to make such severance pay recommendation as her appointment did not come from them,” the source said.

“The President and the Prime Minister have no say in it.”

This masthead understands that Ms Rokoika was not paid for 14 weeks from the time she was appointed in May last year.

Under Section 115(12) of the 2013 Constitution, any remuneration for the FICAC Commissioner is determined by the President, acting on the advice of the JSC, following consultation with the Attorney‑General.

Section 104(8) states that the JSC shall be independent in performing its functions and not be subject to the direction or control of any person or authority, except a court of law.

This masthead further understands that once the current process concludes, the position will be advertised, allowing anyone — including Ms Rokoika — to apply.

Ms Rokoika’s appointment was ruled illegal earlier this month by High Court Judge Justice Dane Tuiqereqere.

The JSC will meet again next Thursday to discuss the issue. Sources say there is no timeframe for when a final decision will be made.
