Sivo Now A Free Man; Acquitted From Indecent Assault Charge

Fiji Bati winger and Parramatta Eels flyer, Maika Sivo is now a free man.

Sivo’s case was called yesterday at the Magistrates Court in Nadi for pre-trial conference, however, the prosecution had made an application to withdraw the matter pursuant to Section 1169 (2)(b)(ii) of the Criminal Procedure Act 2009.

Sivo’s lawyer Mosese Naivalu made an application and submissions for Sivo to be acquitted pursuant to Section 169 (2)(b)(i) of the Criminal Procedure Act 2009.

Magistrate Dalituicama acquitted Sivo from the charge of indecent assault.

Sivo was charged for allegedly indecently assaulting a woman on December 26 last year at a popular resort in Denarau, Nadi while visiting his family in Fiji.

The complainant had claimed that Sivo had tugged her skirt to get her attention at a pool party.

Naivalu said he had made representations to the Director of Public Prosecutions on February 12 based on the CCTV footage of the resort showing Sivo’s hand reached towards the waist of the complainant, however, there was no physical contact from him as she dodged his hand and slapped Sivo instead.
