Kapawale’s lawyer wants another copy of disclosures

The High Court in Suva will sit again today to hear the progress of Tevita Qaqa Kapawale’s request to have another set of disclosures provided to them by the State.
Kapawale is charged with five counts of murder and one count each of attempted murder and criminal intimidation; he appeared before Justice Daine Tuiqereqere with his lawyer, Tobia Ravuniwa.
It was alleged that on May 18, 2021, Kapawale allegedly murdered five men on board FVO Tiro II in the Fiji waters, had attempted to kill a Kaminieli Tucama and intimidated a Mitieli Cama, 49.

Mr Ravuniwa told the court that because they had just recently come on board, they weren’t sure if their client still had his disclosures at the Remand Centre or was it misplaced.
He said they were willing to photocopy the copies if it was going to be a hassle for the State.
Mr Ravuniwa reasoned with the court yesterday to challenge the caution interview.
Justice Tuiqereqere informed Mr Ravuniwa that they will not be revisiting the voire dire ruling as it has already been done.
State prosecution, Triveshni Sharma told the court, challenging the caution interview meant resummoning all the witnesses which was going to be impossible.
She said Kapawale had every opportunity to acquire Legal Aid’s help and representation, however, he declared otherwise.
Justice Tuiqereqere told both parties he wants all pretrial issues sought before he goes for his legal vacation.
