Road Access Row Ends Up In High Court In Lautoka

Lawyers for Denarau Waters PTE Limited filed a writ of summons against the Denarau Corporation Limited PTE at the High Court in Lautoka yesterday.

The writ was filed by Reddy and Nandan Lawyers regarding Beach Road on Denarau Island.

The Denarau Corporation Limited has been given 14 days to inform the court registry whether it will contest the proceedings.

If it fails to state its intention within 14 days, Reddy and Nandan Lawyers will proceed with the action.

Court documents show that the plaintiffs say there existed a road over Lot 8 plan No. SO 3705 (the public road) over which at all material times existed and still exists a public right of way and which goes from the main gate all the way to the beach.

The statements, “For the past eight years the defendant (DCL) blocked the public road by unlawfully and wrongly constructing a gate and keeping the same locked thereby preventing and obstructing the Plaintiff (Denarau Waters) from using the public road.”

The plaintiffs say they have also suffered loss and damages.

They say a permanent injunction against defendants restraining the defendant, its officers, servants, employees and agents from inferring with the Plaintiff’s right of way and over the public road.

Denarau Corporation Limited general manager Bob Speed when contacted last night said: “The matter is in the hands of the lawyers and I cannot really comment on that.”
